In its NPR, the CPSC looked into the possibility of adding additional requirements for bedside sleepers, such as the requirement that these beds meet the minimum side height requirement for bassinets, or at least meet the maximum height requirement for the lowered side rail. The CPSC found, however that these requirements were not feasible or effective in reducing the amount of instances where infants are entrapped by the bedside rail and an adult bed.

Many of the reported incidents in the NPR involved multiuse bedside sleepers that can be converted to other types of use, such as bassinets and play yards. Several commenters suggested that the CPSC include in the proposed rule a different provision for multi-use 4-in-1 bedside crib sleepers that would enable them to meet the minimum side-height requirements for bassinets through the use of an attachment that can be permanently connected or disconnected when the product is not being used as the bassinet.

The CPSC is examining these and other comments received in response to its NPR regarding bedside sleepers. The Commission will be examining these comments when deciding on the final rule, which is expected to be released in November of 2021.
